New Fire Safety Regulations

On the 1st October 2023, new fire regulations under Section 156 of the Building Safety Act 2022 come into force.

These regulations are aimed at strengthening fire safety in all premises regulated by the Regulatory Reform (Fire Safety) Order 2005 (FSO).

Under the regulations, it is a legal requirement for all holiday let properties to have a written, full length fire risk assessment completed on them.

For smaller holiday lets, to assist Responsible Person(s) in complying with the regulations, the Government has published new guidance for small paying guest accommodation. Holiday lets that fall under this criteria are defined as –

  • Single premises of ground floor, or ground and first floor, providing sleeping accommodation for a maximum of 10 persons, with no more than four bedrooms on the first floor, such as houses, cottages and chalets

OR

  • Individual flats (whether within a purpose-built block of flats or a house that has been converted into flats) other than unusually large flats

For larger and more complex holiday lets, i.e. those that fall outside of the above ‘smaller’ criteria, the government guidance document Fire Safety Risk Assessment: Sleeping Accommodation still applies.
